Paul Bérenger: « Avec le jugement du Privy Council de 2006, toutes les décisions du DPP sont sujettes à des Judicial Reviews»
Le leader de l’opposition a interrogé le Premier ministre, sir Anerood Jugnauth, ce mercredi 14 décembre, lors de sa Private Notice Question (PNQ) sur le comité ministériel mis sur pied pour amender la section 72 de la constitution. Paul Bérenger a voulu savoir : « Whether he will state if a Ministerial Committee has been set up to discuss proposed amendments to section 72 of the Constitution to provide for the creation of a Prosecution Commission and, if so, indicate– (a) the terms of reference and composition thereof; (b) if consideration will be given for all the documents circulated in relation to the said proposed amendments since 2000 to be rendered public; and (c) if it is proposed to introduce a Constitution Amendment Bill with the objective of amending section 72 of the Constitution to provide for the creation of the said Prosecution Commission before the end of the year and, if so, indicate how it will take into consideration the Judgment of the Lords of the Judicial Committee of the Privy Council in the case of Jeewan Mohit v/s The Director of Public Prosecutions of Mauritius in 2006? »
Dans sa réponse le PM a déclaré que c’est le Conseil des ministres qui décidera ce vendredi 16 décembre si le gouvernement ira de l’avant avec une Prosecution Commission et que le comité interministériel, présidé par le Premier ministre adjoint Xavier-Luc Duval, comprend Pravind Jugnauth, Ivan Collendavelloo, Pradeep Roopun, Ravi Yerrigadoo, Nando Bodha et Roshi Bhadain. Il a ajouté qu’il ne serait pas approprié à ce stade de divulguer les informations concernant la Prosecution Commission . «We will do our best to have it as soon as possible», a-t-il dit. Le leader de l’opposition lui a fait remarquer que ce gouvernement n’a aucun mandat pour amender la section 72 de la Constitution par rapport aux pouvoirs du DPP. Paul Bérenger lui a aussi rappelé qu’avec le jugement du Privy Council de 2006, toutes les décisions du DPP sont sujettes à des Judicial Reviews et que la dernière démarche du gouvernement est inacceptable.
